These Terms and Conditions apply to the use of DinghyMart.co.uk and to purchases made through the DinghyMart online shop.

Please read these Terms and Conditions carefully before using this website or placing an order. By using this website, placing an order, creating an advert, or submitting information through DinghyMart.co.uk, you agree to these Terms and Conditions.

Nothing in these Terms and Conditions affects your statutory rights.

In these Terms and Conditions, “we”, “us” and “our” mean Tristan Haskins trading as DinghyMart. “You” and “your” mean the person using the website, placing an order, submitting an advert, or otherwise dealing with us.

2. What these terms cover

These Terms and Conditions cover:

  • use of the DinghyMart.co.uk website;
  • purchases made through the DinghyMart online shop;
  • sale of products including the Windie Sailing Watch and Magic Marine buoyancy aids;
  • payment, delivery, returns and refunds;
  • classified adverts and user-submitted listings;
  • links to third-party websites and services.

Our Privacy Policy explains how we collect, use and protect personal information. Our Contact page gives our current contact details.

3. Website use

You must use this website lawfully and responsibly.

You must not:

  • use the website in a way that may damage, overload or impair it;
  • attempt to gain unauthorised access to any part of the website;
  • submit false, misleading, offensive, unlawful or infringing material;
  • copy or scrape website content for commercial use without permission;
  • interfere with the proper working of the website.

We may suspend, restrict or remove access to the website where we believe there has been misuse, attempted fraud, false information, abuse of the advert system, or any other activity that may harm DinghyMart, its users, or third parties.

4. Product information

We try to ensure that all product descriptions, prices, images, availability and delivery information are accurate and up to date.

However, minor differences may occur between product images and the item supplied, including colour, packaging, labelling or manufacturer updates. Product images are for guidance only unless we specifically state otherwise.

For sailing safety-related products, including buoyancy aids, you are responsible for choosing the correct product, size and fit for your own needs. Buoyancy aids and other sailing equipment must be used in accordance with the manufacturer’s instructions and should be checked before use.

A buoyancy aid is not a substitute for proper training, safe seamanship, weather awareness, supervision, or appropriate safety precautions.

5. Orders

When you place an order through our website, you are making an offer to buy the product or products in your basket.

An order is not accepted by us until we have confirmed acceptance, usually by sending an order confirmation or dispatch confirmation email.

We reserve the right to refuse or cancel an order where:

  • the product is unavailable;
  • there has been an obvious pricing or description error;
  • payment is not authorised or is later reversed;
  • we suspect fraud or misuse;
  • delivery to the requested address is not possible;
  • the order has been placed in breach of these Terms and Conditions.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

6. Prices

All prices are shown in pounds sterling.

Prices are as displayed on the website at the time you place your order. Delivery charges, where applicable, will be shown before you complete checkout.

If VAT is chargeable, this will be shown during checkout. If VAT is not shown, no VAT has been charged.

We may change prices at any time, but changes will not affect orders that have already been accepted.

7. Payment

Payments through the DinghyMart online shop are handled securely through WooCommerce using third-party payment providers including Stripe and PayPal.

Depending on the payment method chosen, payment may be processed by Stripe, PayPal, your card issuer, your bank, or another payment service provider.

We do not store your full card details on DinghyMart.co.uk.

Your order will only be processed once payment has been authorised. If payment is declined, reversed, disputed or otherwise fails, we may cancel or pause the order.

Payments may appear on your bank, card or PayPal statement under a name connected with Tristan Haskins, DinghyMart, or Haskins Websites.

8. Delivery

Delivery options, costs and estimated delivery times will be shown during checkout where applicable.

Unless otherwise stated, delivery is to UK addresses only. If you require delivery outside the UK, please contact us before ordering.

We aim to dispatch orders as promptly as possible, but delivery times are estimates only and are not guaranteed unless we have specifically agreed this in writing.

If an item is delayed, we will try to let you know. We are not responsible for delays caused by postal services, couriers, customs, incorrect delivery details, events outside our control, or other circumstances beyond our reasonable control.

You are responsible for providing a complete and accurate delivery address. If an order is returned to us because of an incorrect or incomplete address, we may ask you to pay the reasonable cost of re-delivery.

9. Risk and ownership

The goods become your responsibility once they have been delivered to the delivery address you provided.

Ownership of the goods passes to you once we have received payment in full.

10. Your right to cancel

If you are a UK consumer buying online, you normally have the right to cancel your order without giving a reason.

You may cancel your order from the time you place it until 14 days after the day the goods are delivered to you.

To cancel, you must tell us clearly that you wish to cancel. You can do this by email, by post, or by using the cancellation form at the end of these Terms and Conditions.

Email is usually the quickest method: tristan@dinghymart.co.uk

You then have a further 14 days to return the goods to us.

Please contact us before returning goods so that we can give you the correct return instructions. Returns must be sent by post or courier. Returns cannot be delivered in person.

11. Returning unwanted goods

If you cancel because you have changed your mind, the goods must be returned in a clean, unused and saleable condition, with all labels, tags, instructions, accessories and packaging where reasonably possible.

You may inspect the goods in the same way you would in a shop, but you must not use them beyond what is necessary to check their nature, characteristics and size.

For example, a buoyancy aid may be tried on carefully for size, but must not be used on the water, damaged, marked, soiled, altered, or returned without essential labels or safety information.

You are responsible for the cost of returning unwanted goods unless we have agreed otherwise or unless the goods are faulty, not as described, or incorrectly supplied.

We recommend using a tracked or insured postal service, as you are responsible for the goods until they reach us.

12. Refunds for cancelled orders

Where you cancel under your legal cancellation rights, we will refund the price paid for the goods and the standard delivery charge, if one was paid.

If you chose a more expensive delivery option than our standard delivery option, we only have to refund the cost of standard delivery.

We may make a deduction from the refund if the goods have been handled beyond what is necessary to inspect them, or if they are returned used, damaged, incomplete, marked, soiled or otherwise reduced in value.

Refunds will normally be made using the same payment method used for the original purchase.

We will make the refund within 14 days of receiving the returned goods, or within 14 days of receiving evidence that you have sent the goods back, whichever is earlier.

13. Faulty, damaged or incorrect goods

If goods are faulty, damaged, not as described, or incorrect, please contact us as soon as reasonably possible.

Please include:

  • your name;
  • order number;
  • details of the problem;
  • photographs if useful;
  • whether you would prefer a refund, repair or replacement where available.

If the goods are confirmed to be faulty, damaged, not as described or incorrectly supplied, we will deal with the matter in accordance with your legal rights.

This may include a refund, repair, replacement, or partial refund depending on the circumstances, the age of the goods, and the nature of the problem.

We may ask for the goods to be returned for inspection. Where goods are faulty, damaged, not as described or incorrectly supplied, we will reimburse reasonable return postage costs or provide return instructions.

Nothing in these Terms and Conditions limits your statutory rights in relation to faulty or misdescribed goods.

14. Product care and use

You are responsible for reading and following all product instructions, care labels, safety information and manufacturer guidance.

This is especially important for sailing equipment, buoyancy aids, watches used in marine environments, and any equipment used in or around water.

We are not responsible for damage caused by misuse, neglect, lack of maintenance, incorrect washing or storage, impact damage, normal wear and tear, modification, or use outside the manufacturer’s guidance.

15. Manufacturer warranties

Some products may come with a manufacturer’s warranty or guarantee. Any such warranty is provided by the manufacturer and is in addition to your statutory rights.

Please retain your order confirmation as proof of purchase.

Where possible, we will help you deal with a warranty issue, but the exact warranty terms will depend on the manufacturer’s own policy.

16. Classified adverts and listings

DinghyMart also provides classified advert and listing services for sailing dinghies, sailing equipment and related items.

We reserve the right, at our discretion, to refuse, edit, suspend or remove any advert or listing that we believe is unsuitable, inaccurate, misleading, unlawful, duplicated, abusive, spam-like, or otherwise not appropriate for DinghyMart.

Sellers are responsible for ensuring that their adverts are accurate, lawful and not misleading.

Buyers are responsible for making their own checks before purchasing from a private seller, trader or third party. This includes checking the item’s condition, suitability, ownership, price, documents, location and any other relevant details.

Unless we specifically state otherwise, DinghyMart is not a party to any sale arranged between users through a classified advert. We do not own, inspect or guarantee third-party listed items.

We are not responsible for any loss, dispute, damage, misdescription, failed transaction or other issue arising from a private or third-party sale arranged through the website.

17. Paid adverts and featured listings

Where paid advert upgrades, featured listings or similar services are offered, the price and features will be shown before purchase.

Once an advert or featured listing has gone live, the service may be treated as having started.

If you wish to cancel a paid advert or featured listing, please contact us as soon as possible. Refunds for advert services will depend on whether the service has already started, whether it has already been provided, and your legal rights.

We may refuse or remove an advert even if payment has been made. If we remove or refuse an advert through no fault of yours, we will normally refund the relevant advert fee.

We may refuse a refund where an advert is removed because it breaches these Terms and Conditions, contains false or misleading information, infringes someone else’s rights, or is otherwise unsuitable.

18. User-submitted content

If you submit text, images, adverts, reviews, comments or other material to the website, you confirm that:

  • the content is accurate to the best of your knowledge;
  • you have the right to submit and use the content;
  • the content does not infringe another person’s rights;
  • the content is not unlawful, abusive, defamatory, obscene, threatening or misleading.

You give us permission to display, edit, format, crop, resize and publish your submitted content on DinghyMart.co.uk and related promotional channels for the purpose of operating and promoting the website.

You remain responsible for the content you submit.

19. Website availability

We aim to keep the website available and working properly, but we do not guarantee uninterrupted access.

We may suspend or restrict access to the website for maintenance, updates, security, technical issues, or reasons outside our control.

We are not liable for any loss arising from temporary website unavailability, technical problems, data loss, or interruption of service, except where the law says otherwise.

20. Links to other websites

DinghyMart.co.uk may contain links to third-party websites, including manufacturers, suppliers, advertisers, payment providers, classified listings, affiliate links and other external resources.

We are not responsible for the content, accuracy, availability, privacy practices, terms, products or services of third-party websites.

If you click a third-party link, you should check that website’s own terms and policies.

21. Affiliate links and third-party services

Some links on DinghyMart.co.uk may be affiliate links. This means we may earn a small commission if you click a link or make a purchase through a third-party website, at no extra cost to you.

Affiliate links do not affect your price or your legal rights with the third-party seller.

Where you purchase from another website, your contract is with that seller, not with DinghyMart, unless we clearly state otherwise.

22. Intellectual property

The content on DinghyMart.co.uk, including text, layout, design, logos, images, graphics, page structure and website content, is owned by us or used with permission, unless stated otherwise.

You may view, print or save pages for personal use.

You must not copy, reproduce, republish, scrape, sell, redistribute or commercially exploit website content without our written permission.

Manufacturer names, product names and brand names belong to their respective owners.

23. Limitation of liability

Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or breach of your statutory rights.

Subject to that, we are not liable for:

  • indirect or consequential loss;
  • loss of profit, business, goodwill or opportunity;
  • losses caused by your misuse of the website or products;
  • losses caused by inaccurate information submitted by users;
  • losses arising from third-party adverts, third-party sellers or external websites;
  • losses caused by events outside our reasonable control.

For business users, our total liability for any order will not exceed the amount paid by you for that order, unless the law says otherwise.

24. Events outside our control

We are not responsible for delay or failure to perform our obligations where this is caused by events outside our reasonable control.

This may include postal or courier delays, supplier delays, strikes, severe weather, flood, fire, accident, war, terrorism, pandemic, power failure, internet failure, cyber incident, changes in law, or other circumstances beyond our reasonable control.

25. Privacy and personal data

We use personal data in accordance with our Privacy Policy.

When you place an order, submit an advert, contact us, or use the website, we may collect and process information needed to provide the website, process orders, deal with enquiries, manage adverts, handle payments, deliver goods, prevent fraud, and comply with legal obligations.

Payment information is handled by third-party payment providers such as Stripe and PayPal. Please refer to their own privacy notices for information about how they process payment data.

26. Changes to these Terms and Conditions

We may update these Terms and Conditions from time to time.

The version that applies to your order will be the version in force at the time you place the order.

For general website use, the latest version published on DinghyMart.co.uk will apply.
